Pierce County Court Report

March 6

Lyle J. Feenstra, 42, of Bay City was convicted of resisting or obstructing an officer and sentenced to pay a fine and court costs totaling $249 from a Nov. 9, 2007 incident in Hartland.

March 7

Cory M. Metcalf, 27, of Ellsworth was convicted of possession of methamphetamine and sentenced to three years of probation and suspension of his license for six months. He was ordered to pay court and other costs totaling $363 related to Nov. 12, 2007 incident in the town of Ellsworth.

John J. Woodcock, 17, of River Falls was convicted of fourth degree sexual assault and sex with a child age 16 or older and sentenced to two years of probation concurrent to both charges.

Taylor J. Langer, 19, of River Falls pled guilty to theft-movable property greater than or equal to $2,500 and carrying a concealed weapon and sentenced to pay a fine totaling $198.60 for each charge. The charges were related to a Oct. 30, 2007 incident in the city of River Falls.

March 10

Zebediah N. Tri, 18, of Hager City was convicted of damage to property and sentenced to pay a fine and court costs totaling 129.30 from a Aug. 20, 2007 incident in the town of Trenton.u

Richard L. Smith, 34, of Lakeland, Minn., had an arrest-bench warrant issued for failure to appear at a hearing scheduled for March 10 on charges of theft of a movable property great than or equal to $2,500 from a Jan. 5 incident in the village of Ellsworth.

Brian K. Schultz, 41, of River Falls was convicted of disorderly conduct and sentenced to pay a fine and court costs totaling $185. 60 from a Dec. 18, 2007 incident in the city of River Falls.

March 12

Aaron J. Braasch, 31, of River Falls had a preliminary hearing scheduled for March 20 for bail jumping and entry into/onto a building/construction site/room charges from a March 12 incident in the city of River Falls.

March 13

Matthew D. Field, 29, of Spring Valley was convicted of disorderly conduct and sentenced $249 in fines and court costs relating to a Jan. 20 incident in the town of Spring Lake. Field also was convicted of criminal damage to property and sentenced to one year of probation; a fine of $10, court costs of $20 and restitution of $490.31.


Prescott Police Report

March 8

12:33 a.m. While running stationary radar on Lake Street at Hwy 10, offices observed a vehicle traveling northbound on Lake Street at what appeared to be a high rate of speed. The vehicle was stopped and the driver, Douglas R. Delsman, 52, of Cato, Wis. was issued a speeding ticket for 43 mph in a 30 mph zone.

6:44 p.m. Officers investigated a two car accident in the Holiday gas station parking lot. The driver's were identified as Hayden L. Johnson, 17, of River Falls and Joseph R. Stern, 64, of Prescott.

March 9

10:34 p.m. Officers were dispatched to an anonymous noise complaint at 907 Pearl Street. Upon arrival the officers heard very loud music coming from one of the apartments. They spoke with the resident and advised him of the complaint. He agreed to keep the music down.

March 10

9:40 a.m. The U.S. Post Office in Prescott reported that on Saturday, March 8 at approximately 1:15 p.m. their mail carrier, while delivering mail, found pieces of mail on the ground near a mail box on Pearl Street. The addressee was contacted and advised of what happened. It is unknown if any mail is missing. The found mail was delivered.

2:33 p.m. Joshua R. Gutting, 29 of Ellsworth was arrested on a warrant at 1665 Walnut Street.

4:50 p.m. Police received a complaint that Dwayne E. Gunderson, 44, of Prescott was being disorderly and possibly drunk on his phone. Gunderson was cited municipally for disorderly conduct. When officer's delivered the citation, probation put a hold on Gunderson and he was transported to the Pierce County jail.

8:05 p.m. Officers stopped a vehicle for speeding on Lake Street and Hwy 10. A citation was issued to John W. Kirlin, 42, of Kenyon, Minn. for going 47 mph in a 30 mph zone.

March 11

6:48 p.m. Officers stopped a vehicle on Lake Street and Hwy 10 for speeding. As the officer approached the vehicle he could see that neither the driver or the passenger were wearing seat belts. Orrin J. Horning, 23, of Prescott and Patrick R. Ward, 19, of Prescott were both cited for the seat belt violation and the driver was warned about the speeding.

7:30 p.m. Brittany J. Simones, 17, of Prescott was stopped for failure to yield to oncoming traffic at Hwy 10 and Broad Street North. Simones told the officer she knew what she had done and wasn't thinking. She was cited for her actions.

8:06 p.m. Joseph M. Norell, 51, of Hudson was stopped for speeding at Jefferson Street and Broad Street South. He was cited for going 51 mph in a 35 mph zone.

9:10 p.m. Officers stopped a vehicle for failure to stop at the stop sign on Canton Road and Hwy 10. The driver, Leann M. Hayes, 24, of Prescott stated she knew the reason for the stop and was issued a citation for the violation.

March 12

1:02 a.m. Officers were dispatched to Elm Street for a man having severe abdominal pains. The ambulance was dispatched and after assisting the EMS crew the officers cleared the scene.

6:54 a.m. Parking tickets for $58.60 each were issued to two vehicles at the boat launch for failure to have a launch permit. The vehicles were listed to Anthony D. Horsch, 36 of Hastings and Mark Schanus, 48 of Hastings.

11:25 p.m. Officers stopped a vehicle for going 35 mph in a 25 mph zone at Kinnickinnic Street and Dakota Street. Michael L. Manke, 20, of Westby was issued a citation for speeding.

1:39 a.m. Tally A. Rowan, 32, of Prescott was arrested at Highway 10 and Cherry Street for his third operating while intoxicated and was involved in an accident.

March 13

11:44 a.m. Officers were dispatched to Malone Elementary School for a disorderly male. Charles N. Goodman, 28, of Prescott was arrested for disorderly conduct.

March 16

3:00 a.m. Officers were dispatched to 636 Hilton Street for a domestic situation. Michael V. Williamson, 28, was arrested on one count of domestic related disorderly conduct and transported to the Pierce County jail. Charges are pending with the District Attorney.

4:00 p.m. Officers responded to a male vs. female dispute at 1215 Henry Street. Christopher Palm, 39, was arrested for domestic related battery. He was transported to the Pierce County jail.

PLEASE TAKE NOTICE that the City Council of the City of Prescott, Wisconsin, has declared it intention to exercise its police power in accordance with §66.0703, Wis. Stats., to levy special assessments upon property with the following described assessment districts for benefits conferred upon the property by the improvement of the following streets and the installation of curb and gutter and related work including excavation aggregate base, restoration of the work area; sidewalk, watermain, new water laterals, sanitary sewer, new sanitary sewer laterals and engineering thereon:

A preliminary report of the City Engineer showing proposed plans, estimated cost of improvements and proposed assessments is on file in the City Clerk's office and may be inspected there during any business day between the hours of 9:00 a.m. and 4:00 p.m.

You are further notified that the City Council of the City of Prescott, Wisconsin, will hear all interested persons, or their agents or attorneys, concerning matters contained in the preliminary resolution authorizing the assessments and in the above described report at 7:00 p.m. on the 24th day of March, 2008, at the following location: City Hall Council Chambers, 800 Borner Street North, Prescott, Wisconsin. Meeting Minutes

 

Pursuant to due call and notice thereof, a regular meeting of the Prescott City Council was held Monday, March 10, 2008 in the Prescott Municipal Building, 800 Borner St. Prescott, WI 54021

Call to Order/Roll Call: Mayor Mike Hunter called the meeting to order at 7:00 p.m. Alderpersons present were Deb Ganske, Julie Arndtson, Eddy Wuorenma, Rob Daugherty and John MacLennan. Clair Eaton was excused. City Administrator Elizabeth Freuh, Public Works Director Jerry Killian and Zoning Administrator Jayne Brand represented staff.

Wuorenma/Arndtson motion to approve the consent agenda and the recommendation of the committee contained in the consent agenda which included the approval of February 25, 2008 city council meeting minutes, acceptance of February 28, 2008 PIE Committee meeting minutes, acceptance of March 3, 2008 plan commission meeting minutes, acceptance of March 4, 2008 parks and public property committee meeting minutes, acceptance of March 6, 2008 personnel committee meeting minutes, review of cash balances, budget review for February 2008, approval of payables and review of receivables passed without a negative voice vote.

Police Officer David Grass presented request for a leave of absence for the birth of his child which is due around May 2, 2008. Grass is requesting three weeks of which he will use sick time and the balance will be unpaid. Arndtson/Daugherty motion to approve leave of absence for David Grass as requested passed without a negative voice vote.

Youth Librarian Cynthia Hanson requested a leave of absence from August 19 through September 16, 2008 to allow her to travel to Europe to see her daughter. Library Director Jane Enright said that she would be able to cover Cynthia's duties. Sixty hours will be paid vacation time and sixty-six hours will be unpaid leave. The Library Board has recommended approval of this request. Arndtson/Wuorenma motion to approve leave of absence for Cynthia Hanson from August 19 through September 16, 2008 passed without a negative voice vote.

City Administrator Elizabeth Freuh presented Resolution 03-08 which is the resolution which allows for borrowing for the sewer vactor. Arndtson/Wuorenma motion to approve Resolution 03-08 "A resolution authorizing the City of Prescott to borrow the sum of $224,653 by issuing a general obligation promissory note pursuant to Section 67.12 (12) of the Wisconsin Statutes and authorizing the sale of the note" passed unanimously via roll call vote.

City Administrator Elizabeth Freuh presented 04-08 which is the resolution which allows the city to reallocate proceeds of the 2006 bonding to 2008 street projects. Arndtson/Wuorenma motion to approve Resolution 04-08 "Initial Resolution relating to reallocation of proceeds of general obligation corporate purpose bonds, series 2006A of the City of Prescott, Wisconsin for street improvements" pass unanimously via roll call vote.

Daugherty/Arndtson motion to approve city attorney bill in the amount of $715.00 passed without a negative voice vote.

The council reviewed a written report from the Chief of Police.

City Engineer David Schofield presented the draft of the preliminary special assessment report for Canton Street and Kasson Drive. A public hearing will be held at the March 24, 2008 council meeting regarding the special assessments. Notice will be put in the paper and all property owners will be notified by mail regarding the hearing. The council was questioned if they would be in favor of paying the hook up fees for sewer, lift station and water out of TID #3. Sidewalks are proposed on Canton Street and also along North acres Road. Approximately $50,000 for the sidewalks will come from park impact fees.

City Engineer Russ Kivienmi presented the transportation enhancement grant information. The grant application is due by A[ril 18, 2008. Kivienmi stated that there are two projects that could be applied for. The first project would be the riverfront beautification project between the car bridge and railroad bridge. This project would give greater access to the courtesy dock. The second project would be a bike and pedestrian trail along highway 35 between downtown and Freedom park. There may be issues with this trail since it would involve a state highway so we would have to work with the Wisconsin Department of Transportation. Cedar quoted a price of $750 to write the grant for the riverfront beautification project and $1,500 to write the grant for the trail. This grant is an 80/20 grant so the city would need to provide the 20% match. The grant would be awarded in late 2008 with design in 2010 and completed in 2011. Wuorenma/Arndtson motion to have Cedar submit a grant to the Wisconsin Department of Transportation for riverfront beautification project passed by a majority vote with Daugherty voting nay.

The remodel of Cabana Jo's building was discussed. The main level of the building is being remodeled -- the restrooms are being made larger and the bar is being moved. They will be pulling up the carpet and repainting. The area will be used as an event center and food would be catered in. The kitchen will not be furnished with appliances. Arndtson/MacLennan motion to approve the remodel of Cabana Jo's building as proposed contingent on state approval if needed passed without a negative voice vote.

The council was asked to review the covenants for the business park and give comments back to staff.

The farmland lease for the business park was discussed. The changes to the lease will be the increase of rent from $100 per acre to $130 per acre. The reimbursement of out of pocket expenses would be at the rate of $205 per acre. Arndtson/Wuorenma motion to approve farmland lease for 2008 for the business park with the changes discussed passed without a negative voice vote.

Signage for the beach at the turnaround on Lake Street was discussed. It was felt that there should be a sign at the beginning of Lake Street and one on the beach. The approximate cost of the sign is $100 each. Arndtson/Daugherty motion to approve $200 for signs for the beach at the turnaround at Lake Street passed without a negative voice vote.

The date for the dedication of St. Croix Bluffs Park has been set for Friday, May 2, 2008.

The council discussed the purchase of benches, soccer goals, trash containers and sign for St. Croix Bluffs Park was discussed. Arndtson/MacLennan motion to spend up to $7,000 for soccer goals, benches, trash containers and sign for St. Croix Bluffs Park passed without a negative voice vote.

Wuorenma/Daugherty motion to approve the use of the boat launch by the 3M Club for Sat., May 17, 2008 from 6:00 a.m. to 11:00 a.m. and also allow them to serve beer during this time passed by a majority vote with Arndtson abstaining.

Arndtson/Wuorenma motion to approve a learn to hunt turkey program for the Prescott Sportsman's club on April 12 and 13 at the compost site passed without a negative voice vote.

Arndtson/Wuorenma motion to table the parks master plan and bring it back to parks committee passed without a negative voice vote.

The council was brought up to date on the rail spill incident that occurred on March 5, 2008.

Arndtson/Daugherty motion to go into closed session per Wisconsin Stats. 19.85(1) (c) considering employment, promotion, compensation or performance evaluation data of any public employee over which the governmental body has jurisdiction or exercises responsibility -- union grievance, union negotiations and Wisconsin Stats. 19.85(1) (f) considering financial, medical, social or personal histories or disciplinary data of specific person, preliminary consideration of specific personnel problems or the investigation of charges against specific person expect where par. (b) applies which, if discussed in public, would be likely to have a substantial adverse effect upon the reputation of any person referred to in such histories or data, or involved in such problems or investigation -- animal control contract passed unanimously via roll call vote.

Arndtson/Ganske motion to reconvene to open session passed without a negative voice vote.

Arndtson/Daugherty motion to discontinue animal control services from Top Dog Inc. effective March 10, 2008 passed without a negative voice vote.

Arndtson/Eaton motion to adjourn passed without a negative voice vote.

NOTICE TO ELECTORS OF THE CITY OF PRESCOTT, WISCONSIN

NOTICE HAS BEEN HEREBY GIVEN that the following Initial Resolution has been adopted at the meeting of the Common Council of the City of Prescott, Pierce County, Wisconsin, held on March 10, 2008;

INITIAL RESOLUTION RELATING TO REALLOCATION OF PROCEEDS OF GENERAL OBLIGATION CORPORATE PURPOSE BONDS, SERIES 2006A OF THE CITY OF PRESCOTT, WISCONSIN FOR STREET IMPROVEMENTS

BE IT RESOLVED, by the Common Council (the "Common Council") of the City of Prescott, Pierce County, Wisconsin (the "City") as follows:

 

1. Under and pursuant to the provisions of Wisconsin Statutes, Chapter 67 (the "Act"), the City adopted an initial resolution on July 24, 2006, authorizing the borrowing in an amount not to exceed $1,500,000 for street improvements to Dakota Street, from Kinnickinnic Street to Sycamore Street (the "Dakota Street Project").

 

2. The City issued its $3,430,00 General Obligation Corporate Purpose Bonds, Series 2006A (the "Series 2006A Bonds") to finance several projects, including the Dakota Street Project. Due to cost underruns and use of sewer and water utility funds for the utility portion of the Dakota Street Project, there remains $954,085.35 of proceeds of the Series 2006A Bonds and investment income (the "Proceeds"). The Common Council hereby proposes to reallocate the Proceeds for another street improvement project.

 

3. The City is authorized to borrow, or allocate, $954,085.35 of the Proceeds of the Series 2006A Bonds for the public purpose of financing street improvements to Canton Street and Kasson Drive.

 

Wisconsin Statutes, Section 67.05(7)(b), provides that the Initial Resolution need not be submitted to the electors unless, within 30 days after adoption and recording of the Initial Resolution, a petition conforming to the requirements of Section 8>40 is filed in the City Administrator's office requesting a referendum. This petition must be signed by electors numbering at least 10% of the votes cast for governor in the City at the last general election.
